HSW (Asbestos) Regulations 2016 Reg 13(2)

Regulation 13(2) of the Health and Safety at Work (Asbestos) Regulations 2016 requires an AMP to include each of the following. The template addresses each item in the section noted.

Is an Asbestos Management Plan legally required in NZ?+
Yes. Regulation 13 of the Health and Safety at Work (Asbestos) Regulations 2016 requires a PCBU with management or control of a workplace to ensure a written AMP is prepared where asbestos or ACM has been identified or is assumed to be at the workplace. The AMP must be readily accessible to workers, their representatives, and contractors. This applies regardless of whether the asbestos will be removed or managed in place.
How often must the AMP be reviewed?+
At least every 5 years (Reg 14(a)), and in addition whenever any of the following trigger events occur (Reg 14(b)–(d)): (i) the plan is no longer adequate for managing the risk; (ii) a substantial change is made to the way the risk is managed; (iii) a representative for the workers requests a review. The template includes a review log appendix and a trigger checklist to support this.
Do I need both an AMP and an Asbestos Register?+
Yes — they are separate documents that work together. The Register (required under Reg 12) identifies what asbestos is present and where. The AMP (Reg 13) sets out how the identified asbestos will be managed. The template includes a built-in cross-reference index so each register entry maps to a specific management decision in the AMP. The Asbestos Register is sold separately.
Does this replace a survey?+
No. A survey identifies asbestos at a workplace. The AMP documents how identified asbestos is managed. If your workplace has not yet been surveyed, you can either (i) commission a survey, or (ii) assume that suspect material is asbestos (Reg 10(2)) and manage it accordingly. The template handles both pathways.
Can a school use this template?+
Yes — and you'll need it. All NZ school boards must manage asbestos under HSWA and the HSW (Asbestos) Regulations 2016. Note that from 1 April 2026, the Ministry of Education requires all NZ schools to use accredited suppliers from the MoE list for asbestos-related services (surveys, removal, air monitoring). The MoE requirement does not apply to template purchases — you can use this template and engage MoE-accredited suppliers for the underlying field work.
Is this an AU template relabelled for NZ?+
No. It is authored against the HSW (Asbestos) Regulations 2016 and the WorkSafe NZ Workplace Exposure Standards (Edition 14, effective November 2023). It cites NZ legislation, NZ WES values, NZ standards (AS/NZS where applicable), and WorkSafe NZ guidance documents. AU Model WHS provisions are not referenced.
