Confined space fatalities follow a pattern with grim consistency: the first person is overcome, and the people who die alongside them are the ones who went in to help. That pattern is the reason the standby person must not enter and the reason a rescue plan has to be non-entry by default. A permit that captures gas readings but leaves rescue as "call 111" has not addressed the mechanism by which people actually die in these spaces.

Rescue plans assume someone goes in

Entry rescue requires trained rescuers with breathing apparatus on site and ready. If you do not have that, your plan must be non-entry retrieval, and the permit forces the question.

Atmosphere is tested once at the top

Stratification is real — a space can be safe at the opening and lethal at the base. The permit requires testing at multiple depths and continuous monitoring during occupancy.

Isolation is assumed rather than verified

A valve that is closed is not isolated. The permit requires the isolation method, its verification, and the lock or tag reference.

Confined space entry in New Zealand is governed by the general risk-management duties together with AS/NZS 2865, which sets the recognised practice for identification, entry control, atmospheric testing and rescue.

The permit is built around two findings that recur in confined space fatality investigations internationally — that would-be rescuers make up a substantial share of the dead, and that atmospheres stratify so a single reading at the opening is not representative. Sections 5, 8 and 9 exist because of those two facts.

What makes a space a confined space?+
Broadly, a space that is enclosed or partially enclosed, not designed or intended primarily for human occupancy, with restricted entry or exit, and which is or may become hazardous because of its atmosphere, contents, or the potential for engulfment or entrapment. Appendix C works through recognition, because the spaces people fail to identify are the ones that kill.
Is a permit legally required in New Zealand?+
There is no regulation naming a confined space entry permit in the way the Asbestos Regulations name a removal control plan. The obligation flows from the general duty to manage risk under HSWA s36 and GRWM Regulation 6, with AS/NZS 2865 setting the recognised practice — and recognised practice is the benchmark a regulator or court applies to what was reasonably practicable.
Why can the standby person never enter?+
Because in confined space fatalities a large proportion of the dead are people who went in to help. If the standby person enters, there is nobody outside to raise the alarm or operate the retrieval system, and one casualty becomes two. The role is to stay out and get help — the permit states it in those terms.
What is a non-entry rescue plan?+
Retrieval from outside the space — the entrant wears a full-body harness attached to a retrieval line and a mechanical device positioned at the entry point, so they can be extracted without anyone entering. It is the default because entry rescue requires trained rescuers with breathing apparatus present and ready, which most contractors do not have on site.
How often do we retest the atmosphere?+
Test before entry at multiple depths, retest after any ventilation, and monitor continuously while the space is occupied. Section 7 logs readings at interval with an evacuation trigger stated for each parameter, so the decision to leave is made against a number rather than a feeling.
Do I need this as well as a hot work permit?+
Yes, if the work involves an ignition source. The two permits address different risks and neither substitutes for the other — hot work in a confined space introduces oxygen enrichment, fume accumulation and flammable atmosphere risks that the hot work permit alone does not cover.
